Facebook shares stabilizing, but probes mount

NEW YORK (AP) ? Facebook's initial public offering is the subject of two congressional inquiries and mounting lawsuits as the social network enters its fifth day of public trading.

The shares regained some ground Wednesday, rising $1, or 3.2 percent, to close at $32. They were up another 50 cents, or 1.6 percent, to $32.50 in early premarket trading Thursday. But they are still more than 14 percent below their $38 per share IPO price last week.

The stock's rocky inaugural trading day last Friday was followed by a two-day decline.

The launch was held up by a half-hour delay, caused by glitches on the Nasdaq Stock Market. It was marred further this week as investors began accusing the banks that arranged the IPO of sharing important information about Facebook's business prospects with some clients and not others.

Several shareholders who bought stock in the IPO have filed lawsuits against Facebook, its executives and Morgan Stanley, the IPO's lead underwriter. At question is whether analysts at the big underwriter investment banks cut their second-quarter and full-year forecasts for Facebook just before the IPO, and told only a handful of clients about it.

One lawsuit, filed in U.S. District Court in New York, claims Facebook's IPO documents contained untrue statements and omitted important facts, such as a "severe reduction in revenue growth" that Facebook was experiencing at the time of the offering. The suit's three plaintiffs, who bought Facebook stock on its first day of trading May 18, claim they were damaged in the process.

Morgan Stanley declined to comment. Facebook said the lawsuit is without merit.

Another lawsuit, filed in San Mateo County Superior Court in California, claims Facebook and underwriters misled investors in Facebook's IPO documents. Both lawsuits seek class action status on behalf of investors who bought Facebook stock and lost money on Friday.

"No one gets it perfect, as far as saying what the financial results are," said Anthony Michael Sabino, professor at St. John's University's Peter J. Tobin College of Business. The bottom line, he added, is whether Facebook or the underwriter had material information about Facebook's finances that was not disclosed publicly.

"At this moment, it's still too early to say," Sabino said. "We don't know enough, but this could turn out to be an issue."

What is known is that, in March, Facebook began meeting with analysts at the underwriting firms. The gatherings are a customary part of the IPO process and are designed to help analysts understand the company's business so they can make accurate financial projections.

On May 9, the third day of Facebook's pre-IPO roadshow to meet with prospective investors, the company filed an amended IPO document that said its number of mobile users was growing faster than its revenue.

According to a person familiar with the matter, Facebook then had another meeting with analysts and told them that based on the new information in the filings, the analysts' forecasts should be at the low end of the range that the company gave them in April. The person spoke on the condition of anonymity because they were not publicly authorized to discuss the matter.

Adding to Wednesday's events, Facebook was in talks with the New York Stock Exchange to move its stock from the Nasdaq Stock Market after the botched offering, according to a person familiar with the matter.

Sen. Tim Johnson, D-S.D., chairman of the Senate Banking Committee, said late Wednesday that his panel wants to learn more about the social network's initial offering. The committee seeks briefings with Facebook representatives, regulatory agencies and others.

After the briefings, Johnson said, he will determine whether a hearing should be held.

Also gathering information about Facebook's IPO is the House Financial Services Committee. An aide to that panel said its staff is getting briefings.

The subject is likely to be raised in hearings by the committee in the coming weeks, even though no hearings are planned specifically on the Facebook IPO, the aide said. The aide spoke on condition of anonymity because the House committee's planned inquiry hasn't been publicly announced.

It should come as no shock, then, that the number of people using social media sites via mobile has significantly climbed.

But, what?s even more interesting is that social media apps are becoming communication mediums themselves. A report from the International Telecommunication Union noted that social media apps now provide similar communication platforms like cell phones such as voice and text features.

Facebook recently updated its Messenger for iOS and Android apps, which allow users to see if someone read your message and you can tell if someone is typing. Also, you can see the name of a town or city from which a message was sent.

But, why ? Why would Facebook take the time to create such an app for cell phones? Facebook is already ranked the most popular social media site and stands far ahead of its social competitor, Twitter.

Well, I?d say because cell phone users are easily fascinated by such apps. The new messaging experience will have users hooked instantly.

What does this mean for businesses?

While the Facebook app may not directly correspond to online businesses, businesses could learn a few things from it.

First, customers love mobile technology since they can access the internet on the go. So, if you don?t already have a mobile site, now?s the time to get started on creating one. Following that point, if your business isn?t involved in social media, clearly now is the time. Social media sites have become increasing popular by users everywhere and they offer businesses the opportunity to conveniently and quickly communicate with customers. ?Lastly, just as cell phone users love upgrades, customers love the latest products and services. You can keep your business alive and your competition ahead of the game by offering new products and services.

A few years ago my young son dragged home a stray black cat. It had been tormented by the neighborhood kids, so my son caught it and brought it home figuring that his parents could either care for it or find it a new home. It was a healthy, young female cat, not the friendliest at first but she did warm up to us quickly so we I after a few weeks I made arrangements to have her spayed. By the time of the appointment I noticed that her belly had gotten bigger, and on the ride to the low-cost spay/neuter clinic I realized that she had not gone into heat but had gotten a lot friendlier. Ours is a pro-life house, and it applies even to kittens, so I turned the car around, returned home, canceled the appointment and waited. A few weeks later she gave birth to a litter of four kittens on my son?s bed.

I had never had kittens from day one, but I was determined to raise them into perfect house cats. After a few days I started handling them and had the family spend time with them. As they grew I supplemented their mom?s milk with expensive soft food formulated just for kittens. We brought them into our living room, onto our sofas, and even onto our beds, trying to imprint them with an affection for humans.

Fast forward a few years, and all four kittens are four large cats in my house. One of the cats, the only non-black cat in the lot, is a friendly, well-behaved cat that spends time with us as we move about the house. The other three cats have to be captured to be petted; one grooms himself furiously after being petted, desperate to remove our scent from his fur. The other two will meow at us when they need something, like when their food dish or water bowl is empty but otherwise I rarely see them.

In fact the only time I see them is when the dogs come in from the outside. The cats greet the dogs, padding in and rubbing themselves against them. Sometimes the dogs chase them away, other times they tolerate it, but for all the effort I expended on creating the perfect house cat I realized I have succeeded: I have created the perfect house cat ? for a dog.

Getting older and going, or going back, to work

The tough job market has been so hard on some Americans that they have dropped out of the running altogether.

But here?s a surprising twist: Generally, that?s not been true of older Americans.

The labor force participation rate, or the number of Americans who are working or looking for work, has declined in recent years for every age group except those who are 55 and older, according to a report released this week by the Government Accountability Office.

Older Americans generally have a lower labor force participation rate than other age groups, and for good reason: That?s the point in life when most people retire.

But the percentage of older Americans who are choosing to remain in the labor force, or to get back in it, has steadily been rising over the past 20 years and even continued to increase over the course of the recession and recovery.

About 40 percent of workers age 55 and over were working or looking for work in 2011, the GAO analysis found, compared to about 30 percent in 1990.

That?s in contrast to young and prime-age Americans, who have seen declines in labor force participate rates in recent years.

Ninety-two-year-old May Lee has been working for the State of California for more than 70 years, has served under 10 governors, and has no plans to call it quits. Early TODAY's Lynn Berry reports.

A closer look at the data shows that the real increases are coming from some of the oldest workers. Phillip Levine, an economics professor at Wellesley University, noted that labor force participation among 55- to 64-year-olds has generally been flat in the last five years, at about 64 to 65 percent.

But for workers 65 and over, labor force participation has increased from 15.5 percent in 2007 to 18.4 percent now. Levine?s analysis was based on the Bureau of Labor Statistics data.

There are a number of potential reasons why the labor force participation rate has increased for people who we traditionally think of as being in retirement age.

One explanation may be that older workers are choosing to work longer to make up for investment losses and other financial woes as a result of the recession. Some people age 65 and older also may be getting back into the labor force because they can?t make ends meet on Social Security and retirement savings.

The GAO report said other factors keeping older workers at work may include better health and life expectancies, the increasing number of older women in the labor force and the need to stay at work to retain health benefits.

That a larger chunk of older people are working doesn?t diminish how tough the recession has been on people aged 55 and over, Levine notes.

Although the unemployment rate for older workers has generally been lower than the broader population, a job loss in that age range can be particularly devastating. That?s because it generally takes older workers longer to find a new job, and that long gap in employment just before retirement age can have a harsh impact on their retirement plans.

The GAO report to the Senate?s Special Committee on Aging focused mainly on the effect of long-term unemployment on older workers.

For many Americans, the dream of a worry-free retirement remains elusive. NBC's Anne Thompson explains why.

In testimony before the committee last week, the National Employment Law Project noted that many older workers face the double-whammy of a big employment gap and a resume that gives away their age. Both can be a turnoff to some potential employers.

Levine, who has done extensive research into older workers and the recession, said?many people in that age range are ?limping across the finish line.?

?They find some way to make ends meet from whenever they lose their job at 58 or whatever, and finally when they get to 62, Social Security provides them with a lifeline,? he said. ?It provides a means of getting by.?

Beyond the high-speed hard drive: Topological insulators open a path to room-temperature spintronics

ScienceDaily (May 15, 2012) ? Strange new materials experimentally identified just a few years ago are now driving research in condensed-matter physics around the world. First theorized and then discovered by researchers at the U.S. Department of Energy's Lawrence Berkeley National Laboratory (Berkeley Lab) and their colleagues in other institutions, these "strong 3-D topological insulators" -- TIs for short -- are seemingly mundane semiconductors with startling properties. For starters, picture a good insulator on the inside that's a good conductor on its surface -- something like a copper-coated bowling ball.

A topological insulator's surface is not an ordinary metal, however. The direction and spin of the surface electrons are locked together and change in concert. And perhaps the most surprising prediction is that the surface electrons cannot be scattered by defects or other perturbations and thus meet little or no resistance as they travel. In the jargon, the surface states remain "topologically protected" -- they can't scatter without breaking the rules of quantum mechanics.

"One way that electrons lose mobility is by scattering on phonons," says Alexis Fedorov, staff scientist for beamline 12.0.1 of Berkeley Lab's Advanced Light Source (ALS). Phonons are the quantized vibrational energy of crystalline materials, treated mathematically as particles. "Our recent work on a particularly promising topological insulator shows that its surface electrons hardly couple with phonons at all. So there's no impediment to developing this TI for spintronics and other applications."

The TI in question is bismuth selenide, Bi₂Se₃, on whose surface electrons can flow at room temperature, making it an attractive candidate for practical applications like spintronics devices, plus farther-out ones like quantum computers. Much of the research on electron-phonon coupling in Bi₂Se₃ was conducted at beamline 12.0.1 by a team including Fedorov, led by Tonica Valla of Brookhaven National Laboratory. Their results are reported in Physical Review Letters.

The right tool for the job

To study a TI's surface conductivity, electron transport on its surface has to be separated from total conductivity, including the poorly conducting bulk. One experimental technique, called angle-resolved photoemission spectrometry (ARPES), is adept at doing just this.

ARPES shines bright light, like that produced by the Advanced Light Source, on a sample and captures the electrons that the energetic photons knock free. By recording the angle and energy of these photoemitted electrons on a CCD detector, ARPES gradually builds up a direct graphic visualization of the sample's electronic structure.

"Of the several ARPES beamlines at the ALS, beamline 12.0.1 seems to have an ideal balance of energy, resolution, and flux for research on topological insulators," says Fedorov. "This beamline was used for some of the first experiments establishing that 3-D TIs actually occur in nature, and several teams have worked here validating the characteristics of TIs."

The photoemitted electrons in an ARPES experiment directly map out such features as the material's band structure -- the energy difference, or gap, between electrons bound in atoms' outer shells, the valence band, and charge carriers that are free to rove, the conduction band. Insulators have wide band gaps, semiconductors have narrower ones.

The band structure of the surface states of a topological insulator like Bi₂Se₃ appear as two cones that meet at a point, called the Dirac point. There's no gap at all between the valence and conduction bands, only a smooth transition with increasing energy. This is similar to the band structure of the fascinating material graphene, a single sheet of carbon atoms, the thinnest possible surface. ARPES diagrams of band structures like these look like slices through the cones, an X centered on the Dirac point.

Although graphene and topological insulators have similar band structures, other electronic characteristics are very different. The combinations of different speeds and orientations equivalent to a material's highest particle energies (at zero degrees) make up its momentum space, mapped by the Fermi surface. While the Fermi surface of graphene lies between the conical bands at the Dirac point, this is not true of TIs. The Fermi surface of Bi₂Se₃ cuts high across the conical conduction band, mapping a perfect circle. It's as if the circular Fermi surface were drawn right on the surface of the topological insulator, showing how spin-locked surface electrons must change their spin orientation as they follow this continually curving path.

Values including electron-phonon coupling can be calculated from the diagrams that ARPES builds up. ARPES measures of Bi₂Se₃ show that coupling remains among the weakest ever reported for any material, even as the temperature approaches room temperature.

Says Fedorov, "Although there's still a long way to go, the experimental confirmation that electron-phonon coupling is very small underlines Bi₂Se₃'s practical potential." With continued progress, the spin-locked electronic states of room-temperature topological insulators could open a gateway for spintronic devices -- and for more exotic possibilities as well.

For example, by layering a superconducting material onto the surface of a topological insulator -- a feat recently achieved by a group of Chinese scientists working at beamline 12.0.1 -- it may be possible to create a theoretical but yet unseen particle that is its own antiparticle, one that could persist in the material undisturbed for long periods. Discovery of these so-called Majorana fermions would be an achievement in itself, and could also provide a way of overcoming the main obstacle to realizing a working quantum computer, a method of indefinitely storing data as "qubits."

The experimental examination of strong, 3-D topological insulators is a field hardly more than five years old, and the potential rewards, both for fundamental and applied science, have only begun to be explored.
